Eligibility
* Replacement-Battery-Purchaser Class Members are immediately eligible to participate in the claims program. Unexpired-Warranty-Holder Class Members will become eligible to participate in the claims program if they buy a replacement battery before December 31, 2019.
You are eligible to participate in the Interstate Batteries Settlement Program if:
1. You purchased an Interstate Batteries trademarked battery (meaning the Interstate Batteries, Nationwide, PowerVolt, and Quickstart brands) from an Interstate Batteries authorized dealer in the United States or the District of Columbia from April 19, 2000 through April 30, 2012;
2. Your original battery had an Interstate Batteries pro-rata-warranty;
3. You returned your failed original battery to an Interstate Batteries authorized warranty dealer during your pro-rata-warranty-coverage period; and
4. You then purchased a replacement battery from that dealer at an adjusted price under the pro-rata-warranty between May 19, 2006, and December 31, 2019.
If you meet these requirements, you may be eligible to submit a Tier-One or Tier-Two claim and receive the following:
What You Receive
Tier-One ($5 Product Voucher)
If you are eligible, you can submit a Tier-One Claim Form to receive a $5 product voucher, even if you no longer have your receipt from purchasing a pro-rata-replacement battery. Product vouchers can be used for the purchase of any products sold at an All Battery Center Store or at Interstate Batteries' Online Store, at www.interstatebatteries.com.

Tier-One Claim Forms can either be:
- Submitted through this website by the Submission Deadline; or
- Mailed, by first-class U.S. Mail or overnight delivery, to Interstate Batteries' Customer Service Department in an envelope that has a postmark or other postal service or courier marking that shows that the form was mailed or placed with a courier for overnight delivery no later than the Submission Deadline.
You can find your Submission Deadline below. You cannot submit a Tier-One Claim Form if you previously submitted either a Tier-One or a Tier-Two Claim Form.
Tier-Two ($8.50 Check Card or $12 Product Voucher)
If you are eligible and if you have the receipt from your pro-rata-replacement battery purchase, you can submit your receipt and a Tier-Two Claim Form to receive your choice between a $12 product voucher or a check card for $8.50. Product vouchers can be used for the purchase of any products sold at an All Battery Center Store or at Interstate Batteries' Online Store, at www.interstatebatteries.com.
Your receipt for your pro-rata-replacement battery should show (1) the name of the Interstate Batteries authorized dealer where the replacement battery was purchased; (2) the date of that transaction; (3) the amount paid for that replacement battery; and (4) the battery model/part number of the replacement battery. If some of this information is missing, Interstate Batteries will try to use the information available to validate your claim.

Tier-Two Claim Forms can either be:
- Mailed (together with a receipt for your replacement battery purchase), by first-class U.S. Mail or overnight delivery, to Interstate Batteries' Customer Service Department in an envelope that has a postmark or other postal service or courier marking that shows that the form was mailed or placed with a courier for overnight delivery no later than the Submission Deadline; or
- Emailed as a PDF (together with PDF of a receipt for your replacement battery purchase) to Interstate Batteries’ Customer Service Department by the Submission Deadline. We cannot accept Tier-Two Claim Forms or receipts via email that are not in PDF format.
You can find your Submission Deadline below. You cannot submit a Tier-Two Claim Form if you previously submitted a Tier-One Claim Form. If you purchased multiple pro-rata-replacement batteries that qualify under the Interstate Batteries Settlement Program, you may submit a separate Tier-Two Claim Form (and receipt) for each qualifying replacement battery, with a maximum limit of 10.
Submission Deadline
If you are now eligible to participate, you can submit your claim form now.
If you purchased your replacement battery on or before April 30, 2012, your Submission Deadline is 11:59 p.m. Pacific Time on December 31, 2012.
If you purchased your replacement battery on or after May 1, 2012, your Submission Deadline is one year after the date you bought your replacement battery. Your Submission Deadline can never be later than December 31, 2020.
Certification
By signing and submitting a Tier-One or Tier-Two Claim Form, you certify:
1. You were the original purchaser of an Interstate Batteries trademarked battery (meaning the Interstate Batteries, Nationwide, PowerVolt, and Quickstart brands) from an Interstate Batteries authorized dealer (but not an All Battery Center Store) in the United States or the District of Columbia from April 19, 2000 through April 30, 2012;
2. That battery was covered by a previous Interstate Batteries’ limited warranty with a pro-rata-warranty-coverage period;
3. You returned that battery, during the applicable pro-rata-warranty-coverage period, to an Interstate Batteries authorized warranty dealer for a pro-rata-warranty adjustment on the price of a replacement battery;
4. You then purchased a replacement battery from that dealer at an adjusted price between May 19, 2006, and December 31, 2019;
5. If you purchased your replacement battery on or before April 30, 2012, you are submitting your claim form not later than December 31, 2012;
6. If you purchased your replacement battery on or after May 1, 2012, you are submitting your claim form within one year of the date you bought your replacement battery;
7. You understand that any check card or product voucher will be mailed or emailed to you at an address you provide on the claim form;
8. You read, understood and agreed to the terms and limitations described in the applicable claim form, which appear below, and in the Amended Settlement Agreement; and
9. You understand you will be releasing all your claims in accordance with the Amended Settlement Agreement and the release on the claim form once Interstate Batteries sends you a product voucher or check card.
Additional Certification for Tier-One Claims
1. You have not previously submitted a Tier-One or Tier-Two Claim Form.
Additional Certifications for Tier-Two Claims
1. You have not previously submitted a Tier-One Claim Form, and you have not previously submitted a Tier-Two Claim Form for the same replacement battery;
2. You understand that you cannot submit more than 10 Tier-Two Claim Forms; and
3. You are submitting a receipt for the replacement battery you bought in the pro-rata-warranty-adjustment transaction identified in item 4 above, which if possible should show (a) the name of the Interstate Batteries authorized dealer where you purchased the replacement battery, (b) the date of the transaction, (c) the amount you paid for your replacement battery, and (d) the battery model/part number of the replacement battery.
Release
If you submit a Tier-One or Tier-Two Claim Form and are issued a product voucher or check card, you will give the following release:
I release the Released Parties from any and all claims (whether styled as legal, equitable, monetary, or otherwise, known or UNKNOWN) that were asserted or could have been asserted against the Released Parties in the lawsuit filed in 2010 in the United States District Court for the Northern District of California captioned Deno Milano v. Interstate Battery System of America, Inc. and Interstate Battery System International, Inc., Case No. 10-2125-CW. I also release the Released Parties from any and all claims (whether styled as legal, equitable, monetary, or otherwise, known or UNKNOWN) that I have on the date I submit this claim form and that relate to my purchase, use, return of, or warranty on my original battery, or the purchase of my replacement battery. But I do not release any claims I may have for personal injury or property damage. The Released Parties are Interstate Battery System of America, Inc. or Interstate Battery System International, Inc.; their predecessors, successors, and assigns; the present and former, direct and indirect, parents, subsidiaries, sister corporations, divisions, corporate affiliates, or associates of any of the above; the present and former employees, officers, directors, control persons, members, principals, partners, agents, attorneys, shareholders, advisors, assigns, and representatives of any of the above; and the distributors and authorized dealers owned by any of the above.
You must sign the Tier-One or Tier-Two Claim Form (electronically or by hand).
Product Vouchers Terms & Conditions
Product vouchers are subject to the following limitations:
- Product vouchers can only be used toward the purchase of products at All Battery Center Stores or at Interstate Batteries' Online Store, at www.interstatebatteries.com.
- Product vouchers cannot be applied toward shipping and handling charges; applicable taxes; or legislatively imposed fees.
- No person can ever submit: (a) multiple Tier-One Claim Form, (b) both a Tier-One and Tier-Two Claim Form, or (c) more than 10 Tier-Two Claim Forms.
- Product vouchers are not transferable.
- Product vouchers are not redeemable for cash. They can only be used as a credit on the purchase of merchandise.
- Product vouchers can only be used once, in a single transaction. If you use the product voucher to obtain products that are priced for less than the value of the product voucher, you are not entitled to apply the unused amount to any later transaction or otherwise receive any credit or refund of any unused portion.
- Product vouchers will expire 24 months after the date they are issued.

Interstate Batteries’ Right To Audit Claims
Interstate Batteries has the right to audit claims throughout the Interstate Batteries Settlement Program. If Interstate Batteries believes in good faith that a claim is incomplete, not timely, fraudulent or otherwise fails to meet the specified requirements of making such a claim, Interstate Batteries may reject it. Before Interstate Batteries rejects a claim for any of those reasons, Interstate Batteries will give you written notice of the problem and allow 30 days from the date of the written notice for you to try to fix it. But Interstate Batteries will not notify you about a submission that is too late, because you cannot fix a late submission. If your claim is finally rejected, Interstate Batteries will provide you with written notice.
